SmartOne Sweepstakes Contest Rules

This sweepstakes is only open to all canadian residents and is governed by canadian law and the laws of the province of ontario (and quebec, where applicable).

No purchase necessary. See below for the full sweepstakes details. Participation in this sweepstakes constitutes your full and unconditional acceptance of, and agreement to be legally bound by, these sweepstakes rules.

Sweepstakes period

The sweepstakes begins on January 5th 2024, at midnight and ends on December 31st 2024, midnight EST. (The “Sweepstakes Period”).

Eligibility

To be eligible to win, a person must:

  1. be a resident of Canada,
  2. Who has reached the age of majority in their province or territory of residence, and
  3. who is not an employee of ZucoraHome (The “Sponsor”) or its Market Partners.

The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, Instagram, or other social media companies used by ZucoraHome (“Social Media Companies”). Each entrant in the Sweepstakes agrees to completely release the Social Media Companies of all liability in relation to the Sweepstakes. Any questions, comments or complaints regarding the Sweepstakes must be directed to the Sponsor and not to the Social Media Companies. Entrants must comply with the terms of use of any applicable Social Media Company. Any employee, representative, agent or contest judge of Zucora Inc. or its market partners may not participate in this contest.

This sweepstakes is fully undertaken by ZucoraHome and is conducted in collaboration with all its Market Partners.

How to enter

No purchase necessary. By entering the Sweepstakes, entrants accept and agree to be bound by the Sweepstakes Rules set out herein, and accept the decisions of the Sponsor, or those acting on behalf of the Sponsor, as final and binding, without right of appeal, in all respects, including, without limitation, as to eligibility and/or disqualification of entries. Entries that are incomplete, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of these Sweepstakes Rules shall be disqualified.

Entry: To participate in the Sweepstakes, entrants must follow the following steps:

  1. Step 1: Visit  www.sweepstakes.smartoneplan.com
  2. Step 2: Fill in the sweepstakes participation form
  3. Step 3: Agree to the rules of the sweepstakes
  4. Step 4: Click the Participate button

You will receive 1 entry for following the instructions listed above in full.

Limit: 1 entry per person. Entry remains active until the end of the sweepstake period or until entry is a winner.

Prizes

The following prizes are available to be won:

  1. An electronic voucher worth $2,000 for the retailer where you purchased your furniture or appliances (12 prizes in total. 1 draw per month for the duration of the sweepstake). If a participant entered the sweepstakes without purchasing a SmartOne plan, they will be asked to choose a retailer from options provided by the Sponsor in a location accessible to them. Total value of sweepstake: $24,000.00

Prizes must be accepted as awarded and are not transferable or refundable. The voucher must be redeemed at one time and no residual value can be carried forward. No substitutions except at Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute the Prizes or a component thereof with a prize of equal or greater value, including, without limitation, but at Sponsor’s sole discretion, a cash award. Non-monetary Prizes may not be sold to, bartered with, purchased by or utilized by a third party. Prizes will only be awarded to the individual associated with the winning ticket.

Draw and winner selection

The Sponsor will randomly draw 1 entry on the 30th or 31st of every calendar month for a total of 12 entries within the duration of the Sweepstakes Period. Odds of winning a Prize depend on the number of eligible entries received during the Sweepstakes Period and, subject to any limits on the number of entries as specified in these Sweepstakes Rules, the number of entries by the participant. The Sponsor may reject any entry if, in its absolute discretion, it considers the entry to contain inappropriate content or fail to meet the entry requirements. The draws will be done in London, Ontario, between the 3rd and the 5th day of every month, at 10:00am. The selected potential winners will be contacted via email by approximately the 10th day of every calendar month. Prizes will be delivered to each winner within 30 days of when their name is drawn. Prizes will be delivered under the form of an electronic voucher, printable or to be presented for redemption with Market Partner.

Before being declared a winner, a potential winner must sign and return within five (5) business days of notification a declaration and release prepared by the Sponsor, which, among other things:

  1. requires the eligible winner to correctly answer a time-limited mathematical skill-testing question without mechanical or other aid;
  2. confirms compliance with these Sweepstakes Rules;
  3. confirms where they heard about the sweepstakes and the eligible winner’s postal code so the Sponsor can provide them with a retailer voucher a reasonable distance away from their address;
  4. acknowledges acceptance of the Prize as awarded; and
  5. agrees to release the Sponsor from any and all loss, harm, claims, cost, expense (including legal and other professional expenses), demands, damages, actions or causes of action whatsoever which the potential winner, his/her heirs, executors or administrators may or thereafter have in respect of or relating to participation in the Sweepstakes, participation in any sweepstakes related activity or the acceptance, use or misuse of the Prize.

if the eligible winner:

  1. declines the Prize; or
  2. fails to correctly answer the skill-testing question; or
  3. fails to return the properly executed Sweepstakes documents within the specified time,

then they will be disqualified (and will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to select an alternate eligible entry. If a selected potential winner fails to receive a Prize in accordance with these Sweepstakes Rules, an alternate potential winner will be drawn. Any such alternate potential winner will be required to comply with these Sweepstakes Rules, including the above requirements related to the declaration and release.

General rules

  1. By entering the Sweepstakes, each entrant agrees to abide by these Sweepstakes Rules. This Sweepstakes is subject to all applicable federal, provincial and municipal laws. Void where prohibited by law. The decisions of the Sponsor with respect to all aspects of this Sweepstakes are final and binding on all entrants without right of appeal.
  2. Sponsor reserves the right to cancel, suspend, withdraw or amend this Sweepstakes in any way, without prior notice or obligation, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Sweepstakes as contemplated by these Sweepstakes Rules. Any attempt to deliberately undermine the legitimate operation of this Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
  3. All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor - including, without limitation, government issued photo identification):
    1. for the purposes of verifying an individual's eligibility to participate in this Sweepstakes;
    2. for the purposes of verifying the eligibility and/or legitimacy of any Entry entered (or purportedly entered) for the purposes of this Sweepstakes; and/or
    3. for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Sweepstakes in accordance with these Rules. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of a valid Entry in this Sweepstakes will be the Sweepstakes server machine(s).
  4. Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise illicit means to enter the Sweepstakes, or any other methods not authorized by these Sweepstakes Rules, for example, but not limited to, creating multiple false entries, shall be deemed as tampering and may disqualify you from entering, participating, winning prizes (defined herein), and preclude you from participating in future sweepstakes and promotions, at the sole discretion of Sponsor. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions these rules will be judged void. All Entries become the property of Sponsor upon receipt and none will be returned. Proof of transmission (screenshots or captures, etc.) does not constitute proof of receipt.
  5. Without limitation, the Sponsor, its Market Partners, and its advertising and promotion agencies will not be liable for any failure of the website during the Sweepstakes; for any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; for the failure of any Entry to be received by the Sponsor, its Market Partners, or its advertising and promotion agencies for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website; or any combination of the above. Further, the Sponsor, its Market Partners, and its advertising and promotion agencies will not be liable for any injury or damage to an entrant's or any other person's computer related to or resulting from downloading any material in the Sweepstakes.
  6. In the event of a dispute, Entries will be deemed to have been submitted by the authorized account holder of the email address submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. If the identity of an online entrant is disputed, the authorized account holder associated with the email account at the time of entry will be deemed to be the entrant. A selected entrant may be required to provide proof that they are the authorized account holder of the email address associated with the selected Entry. The sole determinant of the time for the purposes of a valid online Entry in this Sweepstakes will be the Sweepstakes server machine(s).
  7. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. A dispute over the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
  8. In the event of any discrepancy or inconsistency between the terms and conditions of the Sweepstakes Rules and disclosures or other statements contained in any Sweepstakes-related materials, including but not limited to the Sweepstakes entry form, or point of sale, print or online advertising, the terms and conditions of the Sweepstakes Rules shall prevail, govern and control.
  9. By entering this Sweepstakes, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Sweepstakes and in accordance with Sponsor's Privacy Policy (available at: Privacy Policy) unless the entrant otherwise agrees to receive further communications from Sponsor.
  10. By accepting a prize, each winner authorizes the Sweepstakes Organizer and its representatives to use, if required, his/her name, address (city, statements, photographs, images and other representations and recordings, for publicity purposes, in any media, including but not limited to the Internet, without further notice and without compensation without further notice and without any form of compensation. Any participant may be required to sign a confirmation to this effect.
